1. What is the Subclass 491 visa?

The Subclass 491 Skilled Work Regional (Provisional) visa is a temporary visa that allows skilled workers to live and work in a designated regional area of Australia for up to 5 years. It is not a permanent visa at the point of grant, but it provides a clear pathway to permanent residency through the Subclass 191 (Permanent Residence, Skilled Regional) visa after 3 years of complying regional living and working.

The 491 offers 15 bonus points toward the points test, making it the highest bonus points pathway available in Australia's skilled migration program. 2. What counts as a regional area?

3. Points system

The 491 uses the standard points test with 15 bonus points added for either state or territory nomination, or sponsorship by an eligible family member in a regional area.

Occupation list: The 491 accepts occupations from the MLTSSL, STSOL, and the Regional Occupation List (ROL). This is a broader set than either the 189 or 190. If your occupation is not on the MLTSSL or STSOL, check the ROL.

4. Nomination and sponsorship options

6. Pathway to permanent residency, Subclass 191

After holding the 491 and living and working in a regional area for 3 years, you become eligible to apply for the Subclass 191 Permanent Residence (Skilled Regional) visa.

7. Step-by-step application process

  1. Confirm occupation eligibility. Check that your occupation appears on the MLTSSL, STSOL, or ROL. The 491 has the broadest occupation list of the three skilled visas.
  2. Obtain a skills assessment. Mandatory, same as 189 and 190. Obtain a positive assessment before submitting an EOI.
  3. Submit EOI in SkillSelect. Include 491 as one of your EOI preferences. Your EOI is visible to all state and territory migration units.
  4. Apply for state nomination or family sponsorship. Apply to the regional state or territory whose occupation list includes your job, or arrange family sponsorship through an eligible relative.
  5. Receive invitation and lodge application. Once nominated or sponsored, you receive an invitation. Lodge within 60 days with all required documents, health exams, and police clearances.
  6. Activate the visa and move to your regional area. Enter Australia and establish your residence in the designated regional area. The 3-year regional clock starts from when you begin complying living and working regionally.
  7. Meet conditions and track progress toward 191. Keep records of your employment, address, and income. These will be required when you apply for the 191.

Can I work remotely in a regional area for an employer based in Sydney?

This is a grey area. The condition requires you to work in the regional area, not necessarily for an employer based there. Remote work has become more accepted but the DHA may scrutinise this. Seek advice from a registered migration agent.

What if I lose my job in the regional area?

You are not required to be employed continuously, but you must continue residing in the regional area. If you lose your job, you have time to find new regional employment.

Can my family live in a different city while I live regionally?

No. Secondary visa holders are also bound by the regional living condition. Your entire family must reside in the regional area during the 491 visa period.

What happens if I breach the regional conditions?

The DHA can cancel your visa. Maintain records of your address and employment at all times and report compliance annually.

Is Perth a good option for 491 applicants?

Yes. Perth is one of the most liveable options under the 491. It has a strong job market in mining, engineering, construction, and healthcare, a large Indian and Filipino community, and a high quality of life.

Can I apply for 491 without ever having been to Australia?

Yes. You can submit your EOI, receive nomination, and lodge your application from outside Australia. You must enter Australia within the travel validity period after visa grant.
