Terms and Conditions
Effective date: 1 July 2025 · Last updated: 1 July 2025
Important notice: BetterLifeVisa is a points calculation and eligibility analysis tool only. It is not a registered migration agent, does not provide immigration legal advice, and is not affiliated with the Australian Government or the Department of Home Affairs. Please read these Terms carefully before purchasing.
1. About BetterLifeVisa
BetterLifeVisa (referred to in these Terms as 'we', 'us', or 'our') operates the website located at betterlifevisa.com. We provide a self-service digital product that calculates indicative immigration eligibility points scores based on publicly available criteria published by the Australian Department of Home Affairs.
Our product is designed to help individuals understand their potential eligibility for Australian skilled visa pathways. It does this by taking a set of user-provided inputs and running them through the official points scoring criteria to produce an indicative score and analysis.
By accessing our website or purchasing our eligibility report, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our website or purchase our product.
2. Nature of the Service
2.1 What BetterLifeVisa Is
BetterLifeVisa provides the following:
- A digital eligibility report (delivered as a PDF) that calculates your indicative points score across the Subclass 189 (Skilled Independent), Subclass 190 (Skilled Nominated), Subclass 491 (Skilled Regional), and Subclass 462 (Work and Holiday) visa pathways
- An indicative assessment of your eligibility status for each pathway based on your self-reported profile
- General information about each visa pathway including the key scoring factors and occupation list requirements
- Indicative suggestions for how you might improve your points score
2.2 What BetterLifeVisa Is Not
The following limitations apply to our service and you must understand them before purchasing:
- We are not a registered migration agent. We are not registered under the Migration Agents Registration Authority (MARA) and we are not licensed to provide immigration advice under Australian law.
- We do not provide legal advice of any kind. Nothing in our reports, on our website, or in any communication from us constitutes legal advice.
- We are not affiliated with, endorsed by, or acting on behalf of the Australian Government, the Department of Home Affairs, or any state or territory government body.
- We do not conduct formal skills assessments. The skills assessment required for most skilled visa pathways must be obtained from the relevant assessing authority for your occupation (such as Engineers Australia, ACS, VETASSESS, AHPRA, or similar bodies).
- We do not lodge, manage, or assist with visa applications.
- We do not guarantee, predict, or imply any particular visa outcome. The Australian immigration system involves factors that are entirely outside our visibility and control, including invitation round cut-offs, ministerial directions, and changes to legislation.
Key reminder: Before making any decision about your visa pathway or lodging any application, you should consult a MARA-registered migration agent or a qualified immigration lawyer.
3. Eligibility Reports
3.1 How Reports Are Generated
Our eligibility reports are generated by a rules-based calculation engine that applies the official Australian SkillSelect points test criteria to the information you provide. The points values used in our engine are derived from publicly available information published by the Australian Department of Home Affairs.
Reports are generated automatically upon confirmed payment. No human review of individual reports takes place before delivery.
3.2 Accuracy and Limitations
You acknowledge and accept the following limitations of our reports:
- Our reports are indicative only. They provide an estimate of your points score based on the information you have provided and the criteria in effect at the time the report is generated.
- The accuracy of your report depends entirely on the accuracy of the information you provide. If you provide incorrect, incomplete, or misleading information, your report will be inaccurate. We accept no responsibility for reports generated from inaccurate inputs.
- Immigration criteria change. The points values, occupation lists, and eligibility thresholds used in our engine reflect the criteria that were in effect at the time of your report. These criteria are subject to change by the Australian Government at any time and without notice to us. We endeavour to keep our engine up to date but cannot guarantee that our criteria reflect the most current position at all times.
- Occupation list determinations are indicative. Whether your occupation is accepted for skills assessment and whether that assessment is successful is determined by the relevant assessing authority, not by us. Our occupation list check is based on the published lists and may not reflect recent updates.
- SkillSelect invitation cut-offs are outside our scope. Even where a person meets the minimum points threshold for a visa subclass, receiving an invitation to apply depends on the competitive pool at the time. We cannot predict invitation cut-offs.
- State and territory nomination is at the discretion of each state and territory. Our report may indicate that you are eligible to seek state nomination but this does not guarantee that any state or territory will nominate you.
3.3 Delivery
Reports are delivered as a PDF to the email address you provide in the intake form. Delivery typically occurs within 60 seconds of payment confirmation. We are not liable for delays caused by email service provider issues, spam filtering, or factors outside our control.
If you do not receive your report within 15 minutes of payment, please contact us at support@betterlifevisa.com. We will resend the report to your nominated email address.
4. Purchasing and Payment
4.1 Price
The current price for one eligibility report is USD $7.00 (seven United States dollars). This is a one-time payment. There are no subscriptions, recurring charges, or hidden fees associated with purchasing a report.
Prices are displayed in United States dollars. If you pay in a different currency, your bank or card provider may apply a currency conversion fee. We are not responsible for those fees.
4.2 Payment Processing
Payments are processed by Stripe, Inc., a third-party payment processor. By completing a purchase, you also agree to Stripe's terms of service, which are available at stripe.com/legal. We do not store your card number, CVV, or any other payment instrument data on our systems.
Your payment is processed at the time of purchase. We do not offer credit, payment plans, or deferred payment options.
4.3 Failed Payments
If your payment fails, no report will be generated and you will not be charged. You may attempt the purchase again. If you experience repeated payment failures, please contact your card provider or try a different payment method.
4.4 One Report Per Purchase
Each purchase generates one eligibility report based on the inputs provided at the time of that purchase. If you wish to receive a report based on updated information (for example, after completing an English test or gaining additional work experience), you must make a new purchase.
4.5 No Refunds
All purchases are final. The eligibility report is a digital product generated and delivered immediately upon payment, and we do not offer refunds under any circumstances. By completing your purchase, you acknowledge and agree to this no-refund policy. If you experience a technical issue that prevents delivery of your report, contact support@betterlifevisa.com and we will investigate and resend the report. Please contact us before initiating a chargeback; chargebacks initiated without contacting us first may result in your access being suspended.
5. Your Obligations
5.1 Accurate Information
You agree to provide accurate, complete, and truthful information in the intake form. You understand that the quality and accuracy of your report depends entirely on the accuracy of your inputs.
5.2 Permitted Use
You may use your report for personal, non-commercial purposes only. Specifically, you agree that you will not:
- Share, resell, distribute, or publish your report or any part of it for commercial purposes
- Use our report as the basis for providing immigration advice to third parties, whether paid or unpaid
- Attempt to reverse-engineer, reproduce, or replicate our scoring logic or methodology
- Use our website or services for any unlawful purpose
- Attempt to access areas of our system that are not intended for public access
- Provide false information in the intake form for the purpose of testing, stress-testing, or circumventing our payment process
5.3 One Person Per Report
Each report is generated based on the profile of a single individual. You must not submit a form that combines information from multiple people or that does not accurately reflect your own profile.
6. Intellectual Property
All content on the BetterLifeVisa website, including but not limited to the website design, copy, scoring logic, report template, and branding, is owned by or licensed to BetterLifeVisa and is protected by applicable intellectual property laws.
Your purchase of a report grants you a personal, non-transferable, non-exclusive licence to use that report for your own personal immigration planning purposes. No ownership of any intellectual property is transferred to you.
The points criteria used in our engine are derived from publicly available government sources. We claim no intellectual property over the criteria themselves, but we do claim ownership of the manner in which we have implemented, structured, and presented those criteria within our product.
7. Disclaimers and Limitation of Liability
7.1 No Warranty
Our service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by applicable law, we make no representations or warranties of any kind, express or implied, regarding:
- The accuracy, completeness, or currency of the points criteria used in our engine
- The suitability of our report for your particular circumstances
- The uninterrupted or error-free operation of our website or report generation system
- The accuracy of occupation list determinations
- Any immigration outcome that may result from action taken based on our report
7.2 Limitation of Liability
To the maximum extent permitted by applicable law, BetterLifeVisa's total liability to you for any claim arising from or in connection with these Terms or your purchase of a report is limited to the amount you paid for that report (USD $7.00).
We are not liable for any indirect, consequential, special, incidental, or punitive damages arising from your use of our service, including but not limited to:
- Any visa application fees you paid in connection with a visa application made in reliance on our report
- Any costs associated with relocating, resigning from employment, or making other life decisions based on our report
- Any loss resulting from a visa refusal or cancellation
- Any professional fees paid to migration agents or lawyers engaged after reviewing our report
7.3 Consumer Protection Laws
Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under applicable consumer protection laws that cannot be excluded by contract. If any provision of these Terms is unlawful or unenforceable under applicable law, that provision will be severed and the remaining Terms will continue in full force.
8. Immigration Advice Disclaimer
BetterLifeVisa is not a migration agent and does not provide immigration advice within the meaning of the Migration Act 1958 (Cth) or any equivalent legislation. We are not registered with the Migration Agents Registration Authority (MARA).
Our reports are prepared using publicly available information. They represent our calculation of your indicative points position based on that information. They are not prepared by a migration agent, lawyer, or immigration professional, and should not be treated as equivalent to professional immigration advice.
We strongly recommend that before making any decision to lodge a visa application, change your employment situation, or take any other significant action in connection with your immigration plans, you obtain formal advice from a MARA-registered migration agent or a qualified immigration lawyer.
The Australian Department of Home Affairs maintains a public register of registered migration agents at mara.gov.au. We recommend using only registered agents for formal immigration advice.
9. Privacy
Your use of our service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy sets out how we collect, use, store, and protect your personal information. You should read our Privacy Policy before providing us with any personal information.
Our Privacy Policy is available at betterlifevisa.com/privacy.
10. Changes to These Terms
We reserve the right to update or amend these Terms at any time. If we make material changes, we will update the 'Last updated' date at the top of this document. Your continued use of our website or purchase of a report after changes are posted constitutes your acceptance of the updated Terms.
We recommend reviewing these Terms periodically. For purchases made before an update, the Terms in effect at the time of purchase apply to that transaction.
11. Governing Law and Disputes
These Terms are governed by the laws of the state of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from these Terms or your use of our service.
If a dispute arises, we encourage you to contact us at support@betterlifevisa.com in the first instance. We will make reasonable efforts to resolve disputes informally before any formal proceedings are commenced.
